Client Feedback

My fire insurance claim was declined on grounds I did not fully understand. Damai Legal reviewed the wording and explained exactly which clause the insurer was relying on — and why that clause was more limited than the insurer's letter implied. The written analysis gave me a clear basis to challenge the decision through the internal appeal process.
Property all-risks claim — March 2025

The practice was straightforward to deal with. Documents were shared before any call, which I appreciated because I had time to read and prepare questions. The FMOS memorandum they prepared was thorough and clearly set out the factual record. The insurer reached a settlement before the hearing date.

We used Damai Legal for a commercial property dispute involving our shophouse policy. The analysis of the insurer's loss adjusting report was particularly useful — it identified three areas where the adjuster had applied incorrect depreciation figures. That formed the basis of a successful internal appeal.

The policy review service gave me a realistic picture of what I could expect before I decided whether to pursue the claim formally. The adviser told me clearly that one of my three grounds was unlikely to succeed under the wording — that early assessment saved me from building a case on weak foundations.

I came to Damai Legal after my motor insurer offered a settlement figure that I believed was low. The written analysis confirmed there were grounds to request a review. The correspondence service handled the response to the insurer and the matter was resolved at a figure closer to the actual repair cost within eight weeks.

We engaged Damai Legal for a life insurance claim that the insurer had declined on a non-disclosure basis. Their analysis of the material fact question was thorough and identified an important distinction the insurer had overlooked. The engagement was professional, the communication was clear, and the matter moved forward constructively.

Commercial Shophouse — Fire & Contents Claim
Challenge
A commercial tenant received a partial settlement offer from the insurer following fire damage. The insurer's loss adjuster had applied a depreciation schedule that the client considered inconsistent with the policy's reinstatement clause.
Our Approach
We reviewed the loss adjusting report against the policy's reinstatement basis clause and the definition of "day one reinstatement value." We prepared a detailed written response identifying the specific clauses that limited the adjuster's discretion to apply depreciation.
Outcome
The insurer revised the settlement figure following the internal review. The revised settlement represented a 34% increase over the initial offer. The engagement was completed at the correspondence stage without FMOS referral.

Medical Card — Hospitalisation Claim Dispute
Challenge
A family medical policy declined coverage for a hospitalisation event, citing a pre-existing condition exclusion. The policyholder disputed that the hospitalised condition was related to any pre-existing matter disclosed or undisclosed at the time of policy inception.
Our Approach
We reviewed the policy's definition of pre-existing condition and the medical documentation. We prepared a FMOS case memorandum supported by a medical practitioner's letter distinguishing the two conditions. The factual position was presented in clinical chronological order with specific policy clause cross-references.
Outcome
FMOS found in favour of the client. The insurer was directed to settle the hospitalisation claim in full. The client noted that having the documents organised clearly before the hearing made the remote process straightforward to follow.

Professional Indemnity — Coverage Declaration Proceedings
Challenge
A professional services firm faced a third-party claim. The firm's professional indemnity insurer declined to extend coverage, citing a claims notification clause and arguing that the underlying circumstances had been known before the policy renewal date.
Our Approach
Originating summons for a coverage declaration was filed in the Kuching High Court. Pleadings addressed the knowledge test under the claims-made policy and the chronology of the firm's awareness of the potential claim. An expert report on industry practice for PI policy interpretation was coordinated.
Outcome
The court granted a declaration that coverage applied. The insurer was required to defend and indemnify the firm in the underlying third-party claim. The case was resolved at the interlocutory stage without a full trial after the expert report was served.
